Sorry.. my bad... Two things confused here... It's not the CMOS battery, it's auxiliary power. The EEPROM is powered by the battery... 
It is the magnetics on the NIC that are powered by the auxiliary power of the computer so it still gets power to it even after the computer is powered down.
