Apple vs. Google: Inside an Android patent violation

-By Philip Elmer-DeWitt July 16, 2011: 7:45 AM ET-

Steve Jobs claimed that Google "stole" this Apple innovation. Last week, the ITC agreed.

When an iPhone receives a message that contains a phone number or an address -- e-mail, Web or street -- those bits of data are automatically highlighted, underlined and turned into clickable links.

Click on the phone number, and the iPhone asks if you want to dial it. Click on the Web address, and it opens in Safari. Click on the street address, and Maps will display it.

Any Android phone will do the same.

Unfortunately for the three dozen companies that make Android devices, Apple (AAPL) filed for a patent on the underlying system and method that performs these actions in 1996. The patent, U.S. Patent No. 5,946,647, was one of 20 that in March 2010 Apple accused HTC, a leading maker of Android phones, of violating.

Competition is "healthy," Steve Jobs said at the time. But competitors should not "steal."

On Friday, a judge at the U.S. International Trade Commission ruled that HTC had indeed violated two of those Apple patents, including '647.

This could be a big one.

HTC has appealed the decision, which could be overruled by a six-member panel. Or Apple might be willing to cross-license the technology to HTC, assuming HTC has any patented technology to trade. Or HTC could find a way around the patent, although with a technique this basic, that might not be so easy.

As FOSS Patents' Florian Mueller puts it:

"Standing in front of the Great Wall of China, you can also vow to walk around it. That doesn't mean it's a viable option."

In the worst-case scenario, assuming the decision prevails, the ITC could ban the import of HTC's Android devices before the end of the year. The company's 2012 U.S. market share, as Mueller puts it, could shrink to 0.0%.

And if HTC violated Apple's patent '647, so probably have all the other Android manufacturers.

By Mueller's count, this case is only one of 49 that have been filed against the Android operating system, which Google (GOOG) created and distributed for free to those three dozen manufacturers without, it would seem, bothering to license all the underlying technology.

Google has been complaining lately that the U.S. patent system is broken -- a problem it might have considered addressing before it launched Android. When CEO Larry Page was asked about the issue during the company's quarterly earnings call last week, he was defiant. "Android is on a tear," he said, according to TechCrunch. "Despite the efforts of some of our competitors."

FOSS Patents' Mueller, as usual, has the most detailed analysis of the HTC case, included a breakdown of the key "claim charts" that Apple filed with the ITC.

I am sick to death of this patent crap. Its obvious that if a number is in a text you should be able to dial it, my k800 sony could do that and since i still have it I just tested it and it will open links automatically in the browser if it is in a text messages. If maps was available on a phone this old it would prob open it up too.
This is so stupid this means apple has to basically fine every phone company who has made a phone since the color screen era of mobile phones.
Apple are annoyed that android has caught up and now thankfully overtaken ios on smartphones. I really hate apple, they make good stuff but i cant stand the company.
Jailbreaking an Apple phone? Apple tried to get a court ban. Last i heard both Sony and HTC are going to allow root access to their phones right out of the box (that is if the network permits it, but thats a different story)and dont mind about modded os.
The quicker apple stops acting like a spoilt kid the better. They cant even argue they are trying to portect their revenues because they are competing with Microsoft and losing like they were a while ago, they are now bigger but they still keep up the same antics.
TBH if apple went bankrupt 2moro i would cheer.

Microsoft is just as bad.

Android is developed by google but it is open source Apple and Microsoft hate that are, and will forever be, in a losing battle with google, google has its flaws but I am certainly glad that it is google on top and not Apple or Microsoft.

This is getting me really riled up atm, doesn't help i just quit smoking as well lol.

Even my samsung Marine which is a $70 phone has that feature of cutting address.
It was not even a smart phone.

Google and Apple rape everybody else. So I dont see why they shouldn't rape each other. Guess Microsoft and Samsung can get into it to, make it a 4 way.

Wait a god damn second. The iPhone wasn't even the first phone to sport this, Sony Ericsson have been doing this since flip phones were still cool. If someone sent you a text with a phone number or email or something in it it would underline and make it 'clickable'.....HOW CAN YOU PATENT THIS APPLE????

If anyone is wondering, SHIT LIKE THIS IS WHY I HATE APPLE

according to the original article, they had the patent since 1996....I imagine that make it viable, though ridiculous. That's such a basic feature, it's just wrong.

It's like the first person who put chairs on legs suing everyone who followed suite.

I am not worried for one huge reason, can't violate a patent if you do not make money off it. Why Unix could never really go after Linux for theft cause they tried and lost for the fact the OS even though using the same and in a lot of cases similiar code but it was free and Patents are only violated when a product is made to be sold for profit and it is a copy of something.

Android is a free OS, Google makes its money cause not all but a lot of people use the search bar which unless you change it, it uses Google search Engine which is there primary money maker. Since Android is free it can steal a lot of features and not much Apple can do.

Did anyone know Apple stole the hole idea of a grahic user interface and the mouse from Xerox (Spell?)? Well ladies and gentlemen they did.

HTC and Apple lawsuit

So... apparently Apple has filed patent lawsuits against HTC and the U.S. International Trade Commission has ruled that HTC has copied off of two of Apple's patents.

Looks like HTC is in a world of hurt right now. What do you think is going to happen with HTC?

There's already a thread on this, and nothing will happen. The patent is ridiculous and outdated and many many companies breach it, not just htc.

Competition is "healthy," Steve Jobs said at the time. But competitors should not "steal."

This is the part that irks me. Apple steals just as much ideas as any other company...as stated they stole the whole GUI and Mouse idea. Then they go on to say smarmy statements like this as if they've never done such thing. I even remember seeing a key note where steve jobs says they invented the mouse. Bull shit Steve, before you start accusing other companies of "stealing" you should look at your own history.

Stealing ideas is a way of growth, one company creates a idea and then someone steals it and makes it better.

If you guys want to see good evidence of this from both Apple and M$ watch a movie called "Pirates of Silicone Valley" Great movie, you can get it on NetFlix and it will show you how crazy $teve Jobs is and how he almost ruined Apple back in the day before he left the company.

By the way I was looking looking on google and speaking of stealing ideas apple should be happy Linux OS like Ubuntu and Linux Mint does not have patent. From my understanding there is a App store for OSX now right, and it is relatively new? Ubuntu has had that for over a year now and if you want to get technical they had synaptic package manager which is the same thing with out the pretty U/I for downloading.

I guess apple saw the end users that does go to Ubuntu and Linux Mint loved it.

Where is the thread on this, I would like to read what HTC did. Or if you could just give me a brief run down.

Then why has it taken this rip off company over 15 years to attempt to protect "their" patent. Simple, they couldnt take on every other mobile company and win.

Apples, they are only good for eating.

According to Apple everyone has violated them. According to Microsoft everyone has violated them. people need to stop violating each other its unhealthy

Lol, I feel violation is completely healthy, just not throwing stones in a glass house makes you look bad.
